Article or Case Law Search Essay
What is case law? Case law are decisions that has been instituted by a judicial determination and some are placed into action by the body of legislators. Several case law events deals with the critical regulatory healthcare issues. This paper will inform the reader of how the issues relates to the nature, sources, and functions of the law. Issues related to the nature, sources, and functions ââ¬Å"The Affordable Care Act was passed by Congress and then signed into law by the President on March 23; 2010. On June 28, 2012 the Supreme Court rendered a final decision to uphold the health care lawâ⬠. (Healthcare.gov, 2012) The Affordable Healthcare Act affords new means to hold insurance companies responsible and offers strong selections for customers. The Medical Loss Ratio (MLR) is known as a percentage that healthcare insurers must meet or better known as the MLR requirement. Healthcare insurers are required by the Affordable Care Act to produce a reimbursement to its consumers. The Medical Loss Ratio financial measurement used in the Affordable Care Act to help ensure that health plans provide significant value to users. The following is an example of how insurers use the MLR ââ¬Å"if an insurer uses 80 cents out of every premium dollar to pay its customersââ¬â¢ medical claims and activities that improve the quality of care; the company has a medical loss ratio of 80%. A medical loss ratio of 80% indicates that the insurer is using the remaining 20 cents of each premium dollar to pay overhead expenses, such as marketing, profits, salaries, administrative costs, and agent commissions. The Affordable Care Act sets minimum medical loss ratios for different markets, as do some state laws.â⬠(Healthcare.gov, 2012) The Affordable Care Act Law forces payer insurance policies for persons or groups to devote at least 80% of payments of medical careà directly paid on behalf of the patient, that are meant to improve their quality of care. Payers marketing to big groups are required to spend 85% of those payments made for care and quality enhancement. The Affordable Care Act rule will not apply to companies that function as self-insured plans. Payer companies are required to report each year to the Human Services department regarding payments spent on quality improvement and health care services and any rebates applied to consumer accounts. The first re port, was in 2011, and the newest in June of 2012. Payers are obligated to make the first of rebates to consumers in August of 2012. (Healthcare.gov, 2012) This Act has good and bad ramifications. First the Act which is source law from the legislator, which not only creates new rules of law it also sweeps away existing inconvenient rules. The act has potential for ensuring that quality of care continues to improve, however companies that do not meet these standards are required to give a premium rebate to the consumer. What the law doesnââ¬â¢t say is how much of a rebate is required to give. The 20% is for overhead and quality improvements. The overhead of the company could be more than 20% therefore the consumer is left with no rebate. That rebate really only works out to be very small 10-15 dollars per consumer. Companies like large insurance payers spend 10 times those figures on quality improvements. I have worked in Healthcare for several years and in early 2005 legislation went through that required all Healthcare organizations adopt some sort of meaningful use Electronic Health Record by 2014. This is a massive under taking for most healthcare institutions and the government was only offering up to $40,000 per healthcare organization to assist with this implementation. For a lot of smaller provider organizations this was a good deal, however the larger insurance companies and healthcare organizations would be spending millions on Electronic Health Records. According to the Centers for Medicaid and Medicare (CMS) only about 25% of healthcare organizations as of 2011 are up and running on a meaningful use EHR. (Centers for Medicare and Medicaid Services, 2012) These improvements the healthcare organizations are making with regards to EHRs are far surpassing the required 20% a year even if you break it down each year. ââ¬Å"October 1, 2013, medical coding in U.S. health care will be modified from ICD-9 to version 10. All healthcare related systems that is protected by the Health Insurance Portability andà Accountability Act (HIPAA) are required to make the transition, not just those healthcare institutions that submit Federal Medicare or State Medicaid claims.â⬠(Centers for Medicare and Medicaid Services, 2012) This is yet another quality improvement mandated by the source law of the Legislator that will cost healthcare organizations millions to implement. Conclusion Do the current process improvements that are currently mandated for all healthcare organizations count toward the 20% of profits made from premiums and services or do healthcare organizations still need to utilize the 20% for quality improvements on top of the already mandated improvements that the government requires to implement in the next few years? Healthcare all over the world often sometimes face many obstacles which includes different law cases. Of Mice And Men Characters Essay
In ââ¬ËOf Mice And Men,ââ¬â¢ all the characters have different problems, whether they are physical, mental or personal. Although the two characters who I feel have the most problems are Crooks and George. Crooks, the black stable buck is forever being pick on by the other men at the ranch, mostly because of his colour. In the time in which the book was set, black people in America were thought of as lower than white people. At the ranch, Crooks cannot live in the bunk-house with all the other men, but he has to sleep in the harness room, at the back of the barn. In this room he is surrounded by all the unused horse tack, and therefore has hardly any space for his personal belongings. Crooks is given no privacy, and gets quite cross because he is not allowed to enter the bunk-house but the other men can just walk into his room. In the book he says to Lennie, ââ¬Å"Youââ¬â¢ve no right to come into my room, nobody got any right in here but me.â⬠After he has talked to Lennie for a while, he starts to enjoy having someone to talk to, because when he is in his room by himself, there is no one he can talk with. I think that he likes talking to Lennie because he realized that Lennie is slow, so Crooks can say what he wants and Lennie will not remember anything. To get the other men back for teasing him, he becomes very sour when they enter his room, and as he passes the other men he ignores them, as a pay back for the names they call him. Although I do feel that Crooks gets extremely lonely. All day long he is on his own, he cannot work because he has a crooked back, from once being kicked by a horse, so he has to stay behind at the ranch and generally look after the place. When he was abused by Curley, he cannot answer back, because Curley is the Bossââ¬â¢ son, and he knows that if he gets fired, he will probably not get another job because of his disability. The other man who I think has a lot of problems is George. He has to take Lennie with him everywhere, although, Lennie often gets into trouble and this gets George into trouble too. Without Lennie around him George could have such a good life, ââ¬Å"God almighty, if I was alone I could live so easy. I could get a job and work, anââ¬â¢ no trouble. No mess at all, and when the end of the month come, I could take my fifty bucks and go into town and get whatever I want.â⬠This shows that without Lennie with him, causing trouble, he could keep a good job, and spend his time in the way he wants to, without having to think about anyone else. Although I do think that George likes Lennie, as he is always there to talk to and to share dreams with, they are obviously very close, but George does get annoyed with him, especially because Lennie finds it hard to remember things, such as where they are traveling to. Although he does seem to remember every bad word George says about him. When George talks of the ââ¬Ëlittle placeââ¬â¢ theyââ¬â¢re going to get, his face lights up and he really enjoys seeing Lennie happy and even though George is stuck with Lennie, he still likes having him there. When George is talking to Slim, in the book, he tries to cover up for Lennieââ¬â¢s mistakes in Weed, as he knows that Lennie would never hurt anyone on purpose. At the end of the book when George shoots Lennie he knew that he had to kill him. I think that partly the reason for this is because George knows that Lennie will be shot any way, but if he did it, it would be out of love and protection, and not revenge and hatred. George also knows that he cannot go on with Lennie, always running away from some kind of trouble that Lennie has caused, and the incident at the ranch was probably the last straw. Out of the two men described, I think that the person with the most problems is George. In the first part of the book, he always had Lennie with him, making things very difficult for him to have any privacy or time for himself. Lennie prevented him from ever keeping a job, and this often got him into trouble. At the end of the book, when George shot Lennie, he felt awful, because he was killing his best, and probably only friend. George would always live with the memory of Lennie, and the memory of how he shot him. All throughout the book George was telling Lennie that the other guys on these ranches move from place to place, having nobody. Now George would be like these other guys, but before he and Lennie. I think that George has more problems than Crooks, because in America in those times, all black people were treated lower than whites. Crooks cannot help this problem, because wherever he goes, he would receive the same kind of abuse. Another disadvantage Crooks has, is his crooked back, but again, he cannot help this so he did not create the problem. I feel very sorry for George, as he and Lennie have been through so much together, at some times, he wished that he never had to stay with Lennie, but now everything it over for him and he wants Lennie back.
